Collection of personal information

The type of personal information collected by us may include your full name, date of birth, address, email address, bank account details, occupation, and any other information we may need to identify you.

We may also collect personal information to comply with our obligations under the AML/CTF Act when conducting client due diligence.  This may include information from identification documents (such as your passport, drivers licence etc.) and information relevant to assessing money laundering or terrorism financing risk.

When we refer to personal information, we mean information or an opinion about an identified individual. This information may include facts or an opinion about you. The personal information we hold about you may also include sensitive information.

We may collect this information directly (or indirectly) from you to comply with our obligations under AML/CTF Act when completing client due diligence.  We may collect this information from you when you provide us with instructions in person, by email or by phone.  We will only collect information necessary to perform our services and functions including our AML/CTF obligations.

We may also collect information about you from third parties involved in the transaction, which may include:

  • real estate agents and other property professionals
  • financial institutions involved in the property transaction
  • other legal representatives involved in the transaction
  • identity verification providers and information brokers
  • regulatory bodies and government agencies including AUSTRAC
  • anybody who represents you
  • other persons or entitles as required or allowed by law.

When providing personal information about another person (e.g. spouse, relative etc.), you must ensure you have their consent and inform them of our policy. 

If you choose not to provide us with personal information, we may not be able to carry out your instructions or complete your conveyancing transaction.

 

Disclosure of personal information

Generally, we will only use personal information for the purpose for which it was collected.  We will ensure that any use or disclosure of personal information is not inconsistent with our information handling obligations under the AML/CTF Act.  We may use your personal information as required by or authorised by law.

We may disclose your personal information to a range of parties involved in the transaction, which may include:

  • external service providers so they can provide a services we have contracted out to them
  • companies that provide information or IT services and other services to us
  • financial institutions involved in the property transaction
  • regulatory bodies and government agencies including AUSTRAC
  • other parties and their legal representatives involved in the transaction
  • anybody who represents you
  • other persons or entitles as required or allowed by law.

Security of personal information

We may retain your personal information electronically or in hard copy.  We are bound to keep your person information secure and treat it a confidential.  We cannot guarantee the security of your personal information as the internet is not a safe environment, however, we will take reasonable steps to ensure the personal information is protected from misuse, interference, loss, unauthorised access, modification, or disclosure.

We will attempt to ensure that any personal information we store is correct and up to date.  If you believe your details have changed or if you believe the information we hold about you is inaccurate, please let us know.
